Constitutional law expert from the Council for the Advancement of the South African Constitution (Casac), Lawson Naidoo, says the dismissal by the Constitutional Court of the application brought by the uMkhonto weSizwe Party (MKP) and its leader, Jacob Zuma did not come as a surprise.

They wanted to challenge President Cyril Ramaphosa’s decision to place Police Minister Senzo Mchunu on special leave and appoint Professor Firoz Cachalia as acting minister.

The matter was heard in the Apex court on Wednesday.

Naidoo says the Constitutional Court shouldn’t have accepted the application in the first instance.

“It is not surprising that the Constitutional Court has dismissed the application brought by Mr Zuma, and the MK Party regarding the establishment of the Madlanga Commission of Inquiry, as well as issues relating to Minister Senzo Mchunu; as well as the potential appointment of Professor Cachalia to the cabinet. This was the matter that should not have been entertained by the Constitutional Court in the first place. Because quite clearly, it didn’t entertain the court’s jurisdiction. There was no case made out either for exclusive jurisdiction of the court or for direct access to the court,” says Naidoo.
