Human rights lawyer, Advocate Simba Chitando, says the High Court in Pretoria is likely to rule in favour of the family of Zambia’s former president, Edgar Lungu.

This after the court granted an interdict halting the burial of Lungu yesterday.

The Zambian government wants Lungu to have a state funeral in Zambia – something Lungu’s family has refused to allow because of his bitter political feud with current Zambian President, Hakainde Hichilema.

Deputy Judge President Aubrey Ledwaba said parties had agreed after consultations that Lungu would not be buried until the case is heard.

The next hearing regarding this court case will be held on August 4.

Chitando says South African law favours the family.

“The South African court is bound by South African law, and this is something that’s probably very difficult for the Zambian government to hear – is that the South African law is on the side of the family. The family has a right to bury their loved one in a country that they wish to bury their loved one. It would be a very different situation or circumstance if the South African government said that they do not want former president Lungu to be buried in South Africa – it would be a very different situation.”
